BREAKING: Supreme Court rules Biden border agents can remove Texas' border barriers

The US Supreme Court ruled that Border Patrol agents are allowed to remove razor wire that was installed by Texas.  

In the case of the Department of Homeland Security v Texas, the Court stated "The application to vacate injunction presented to Justice Alito and by him referred to the Court is granted. The December 19, 2023 order of the United States Court of Appeals for the
Fifth Circuit, case No. 23-50869, is vacated.
Justice Thomas, Justice Alito, Justice Gorsuch, and Justice Kavanaugh would deny the application to vacate injunction."

As reported by NBC News, a 5-4 decision allowed the agents to go forward with what has been a months-long legal slog between the Texas government and the Biden administration.  

The four justices that ruled against the emergency request from Biden to vacate the order were Justices Clarence Thomas, Samuel Alito, Neil Gorsuch and Brett Kavanaugh. 

President Joe Biden and his administration have argued that the razor wire prevents border patrol agents from reaching migrants who have already come into the US.  

Republican Texas Gov. Gregg Abbott had the razor wire installed near the Rio Grande at Eagle Pass to deter illegal immigrants from coming into the state amidst the ongoing border crisis.

After the Biden administration had Border Patrol agents cut the razor wire down earlier in 2023, Texas responded with a lawsuit against the Biden administration in October. A court ruled that Biden could not cut the wire. The Supreme Court overturned it.

Amidst the ongoing legal battle between the Biden administration and the government of Texas, it was revealed in December that the Department of Justice has also threatened to sue Texas over Abbott signing into law an act that would make it a state crime to illegally cross the border.   

The Supreme Court decision comes on the heels of Biden's DHS and the White House claiming that the deaths of some illegal immigrants in the Rio Grande were the fault of Texas border policies and Border Patrol was blocked from rescuing the drowning migrants.  

This later turned out to be false as border patrol only requested to enter the area blocked off by Texas' extra border security after the drownings had occurred.
